Trial court erred by applying the wrong "self defense" standard

December 7, 2011

The elements of self defense differ depending on whether deadly force or non-deadly force was used in self defense. The Seventh District Court of Appeals for Monroe County reversed a conviction where the trial court erred by applying the "deadly force" standard to a case where "non-deadly force" was used. The Court of Appeals reversed and remanded for the elements to be applied when non-deadly force is used as you can read in State v. Meisel, 2011-Ohio-6426, here.
